AUDIO AND VIDEO INTERVIEW RELEASE AND CONSENT FORM
For recorded audio and video call interviews used in editorial content
This Release and Consent Form (“Release”) is between EMS Media Ltd (together with its associated brands, group companies, and authorised partners, “EMS Media Ltd”, “we”, “us”) and the individual named in the signature block below (“you”, the “Contributor”), in connection with a video call interview that is recorded (the “Interview”) for potential use in editorial, social, and news-style content published by EMS Media Ltd (the “Content”). By signing below, you agree to the terms of this Release.
1. Consent to Recording
You agree that EMS Media may record the Interview by video call, including your video image, voice, likeness, name, statements, on-screen background, and any material you share on screen. You understand the Interview is being recorded for the purpose of creating Content and confirm you are speaking voluntarily. You also agree that any audio sent by you to EMS Media Ltd and its staff will be used to create Content, and confirm you have sent this audio voluntarily.
2. Grant of Rights
You grant EMS Media Ltd a worldwide, perpetual, irrevocable, royalty-free, sub-licensable licence to use, reproduce, edit, adapt, translate, caption, add commentary or graphics to, publish, broadcast, distribute, and otherwise exploit the Interview (in whole or in part) and your name, voice, likeness, and statements captured in it, in any Content and in any media or format now known or later developed, including social media platforms, websites, streaming services, and syndication to third-party outlets or partners.
3. Editorial Control and Editing
You acknowledge that EMS Media Ltd has full editorial discretion over the Interview, including the right to cut, edit, shorten, caption, subtitle, add commentary or music to, and combine it with other footage or material. EMS Media Ltd is under no obligation to use, publish, or continue to make available any part of the Interview, and may remove published Content from circulation at its discretion. You will not have the right to review, approve, or veto the final edit prior to publication unless separately agreed with EMS Media Ltd in writing.
4. No Compensation
Your participation in the Interview is voluntary. Unless a fee has been separately agreed with EMS Media Ltd in writing prior to the Interview, you will not receive any payment, royalty, or other compensation for the Interview or its use in Content, including where Content performs well or is reused, syndicated, or licensed to third parties.
5. Accuracy of Statements and Indemnity
You confirm that any statements, opinions, or information you provide during the Interview are, to the best of your knowledge, true and are your own views, and that you have the right to share them. You agree to indemnify and hold EMS Media Ltd harmless against any claims, losses, or costs arising from statements you make during the Interview that are false, defamatory of a third party, or that infringe the rights of any third party.
6. Release of Claims
To the fullest extent permitted by law, you release and discharge EMS Media Ltd from any claims, demands, or liability arising from the recording, editing, or publication of the Interview and its use as described in this Release, including any claims for defamation, invasion of privacy, infringement of image or publicity rights, or moral rights, save where such claim arises from EMS Media Ltd's fraud, wilful misconduct, or gross negligence, or cannot be excluded as a matter of law.
7. Ownership
EMS Media Ltd owns all copyright and other intellectual property rights in the recording of the Interview and in any Content
created from it. This Release does not transfer any ownership of your own pre-existing intellectual property, but does grant EMS Media Ltd the licence described in Section 2 to use it as captured in the Interview.
8. Your Data
EMS Media Ltd will process your name, image, voice, and any other personal data captured during the Interview in order to produce and distribute the Content, in accordance with applicable data protection law (including the UK GDPR and Data Protection Act 2018). Our lawful basis for this processing is your consent, given by signing this Release, and our legitimate interest in producing editorial content. You may ask questions about how your data is used by contacting us using the details below.
9. Withdrawing Consent
You may withdraw your consent to the use of the Interview at any time before Content is published by giving written notice to EMS Media Ltd, in which case EMS Media Ltd will not knowingly proceed to publish that footage. Because Content may be published, shared, and reshared quickly and by third parties once live, EMS Media Ltd cannot guarantee removal of Content that has already been published, but will consider reasonable removal requests made after publication at its discretion.
10. No Guarantee of Publication
You understand that EMS Media Ltd is not obliged to publish, or to notify you in advance of publishing, any Content based on the Interview, and that EMS Media Ltd may hold, archive, or decide not to use the Interview at all.
11. Capacity and Eligibility
By signing below, you confirm that you are 18 years of age or older, have full legal capacity to enter into this Release, are participating of your own free will, and have read and understood this Release in full before signing.
12. Governing Law
This Release is governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction over any dispute arising from it.

This Release sets out the entire agreement between you and EMS Media Ltd regarding the Interview and supersedes any prior discussions on the subject. It may only be varied by a written document signed by both parties.
